Nagahama Residence Terms and Conditions
Article 1 Scope of Application
1. Accommodation contracts and related contracts concluded between Nagahama Residence (hereinafter referred to as “the Facility”) and guests shall be governed by the provisions of these Terms and Conditions, and matters not specified herein shall be governed by laws and regulations or generally established customs.
2. If the Facility agrees to special terms that do not conflict with laws or established customs, such special terms shall take precedence over the provisions of the preceding paragraph.
Article 2 Application for Accommodation Contract
1. Persons wishing to apply for an accommodation contract with the Facility shall provide the following information to the Facility:
(1) Guest's name and contact information
(2) Date of stay and estimated arrival time
(3) Accommodation fees
(4) Other matters deemed necessary by the facility
2. If any changes occur to the information provided under the preceding paragraph, the guest must promptly notify the facility of the revised information.
3. If a guest requests to extend their stay beyond the check-in date specified in Item 2 of Paragraph 1 during their stay, the facility shall treat such request as a new application for an accommodation contract at the time the request is made.
Article 3 Formation of the Accommodation Contract
1. The accommodation contract shall be established when the facility accepts the application referred to in the preceding article.
However, depending on the accommodation plan, the contract may be established after the facility confirms the payment following the application referred to in the preceding article.
Notwithstanding the foregoing, this shall not apply if the facility proves that it did not accept the application.
2. Once the accommodation contract is established pursuant to the preceding paragraph, the accommodation fee must be paid by the date specified by the facility.
Article 4 Refusal to Enter into an Accommodation Contract
The facility may refuse to enter into an accommodation contract in the following cases:
(1) When the application for accommodation does not comply with this agreement.
(2) When the facility is fully booked and there is no availability.
(3) When the person seeking accommodation is deemed likely to engage in behavior that violates laws and regulations, public order, or good morals in relation to accommodation.
(4) When the person seeking accommodation is clearly suffering from physical or mental illness or an infectious disease.
(5) When the person seeking accommodation is a member of a designated organized crime group or designated organized crime group member (hereinafter referred to as “organized crime group” and “organized crime group member”) as defined by the Act on the Prevention of Unjust Acts by Organized Crime Group Members, or their associates, or other antisocial forces.
(6) When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable circumstances.
(7) When a minor attempts to stay without the permission of a guardian.
(8) When a reservation is made without the intention of staying.
(9) When the circumstances fall under any other provisions of laws and regulations that permit refusal of accommodation.
Article 5: Guest's Right to Cancel the Contract
1. Guests may cancel the accommodation contract by notifying the facility.
Except for plans where changes or cancellations are not permitted under the cancellation policy, guests may cancel the accommodation contract at their discretion by notifying the facility. In such cases, the facility will charge a cancellation fee in accordance with the cancellation policy.
2. If a guest fails to arrive by 12:00 PM on the day of check-in without notifying the facility, the facility may treat the accommodation contract as having been canceled by the guest and proceed accordingly.
Article 6 The Facility's Right to Cancel the Contract
1. The facility may cancel the accommodation contract in the following cases:
(1) When the guest is deemed likely to engage in behavior that violates laws and regulations, public order, or good morals in relation to the accommodation, or when such behavior has already been committed.
(2) When the guest is a patient with a specific infectious disease.
(3) When it is impossible to accommodate the guest due to reasons attributable to force majeure such as natural disasters.
(4) When the guest is a member of a designated organized crime group or a designated organized crime group member (hereinafter referred to as “organized crime group” and “organized crime group member”), or a related party thereof, or otherwise associated with antisocial forces.
(5) When the guest has committed acts of violence, threats, extortion, or unreasonable demands against the facility or its staff (employees), or has demanded unreasonable burdens, or when it is determined that the guest has previously committed such acts.
(6) When the guest fails to comply with the prohibited items specified in the facility's terms of use.
(7) When engaging in acts that hinder fire prevention, such as smoking in bed in a guest room or tampering with fire safety equipment.
(8) When the accommodation contract was concluded through a travel agency or similar entity, and notification from such entity has not been confirmed.
(9) When the circumstances fall under any of the provisions of Article 4 or other applicable laws and regulations that permit refusal of accommodation.
2. Notification of cancellation based on the preceding paragraph shall be made orally or by telephone, email, or written notice to the contact information provided by the guest in accordance with Article 2. If such notification cannot be delivered to the contact information provided in accordance with Article 2, the provisions of Article 3, Paragraph 3 shall apply, and after a certain period of time has elapsed, the notification shall be deemed to have been delivered.
3. When the facility cancels the accommodation contract based on the provisions of the first paragraph, except in the cases specified in the second and third items of the first paragraph, no refund of the accommodation fee shall be made.
Article 7 Registration of Accommodation
1. Guests shall register the following information online in accordance with the instructions provided by the facility after making a reservation.
(1) Full names, ages, genders, addresses, and occupations of all guests
(2) For foreign nationals not residing in Japan: nationality, passport number, port of entry, and date of entry
(3) Departure date and scheduled departure time
(4) Other information deemed necessary by the facility
Article 8 Room Usage Hours
1. Guests may use the facility from 3:00 PM on the check-in date until 12:00 PM on the check-out date.
However, in cases of consecutive stays, the room may be used throughout the day except for the arrival time and departure date.
2. The facility may, at its discretion, permit use of the guest room outside the hours specified in the preceding paragraph.
In such cases, the following additional fees will be charged:
(1) For an earlier check-in time, a fee of 4,000 yen per hour will be charged.
However, this is subject to prior reservation and is limited to a maximum of one hour.
(2) An extension of the check-out time will be charged at 4,000 yen per hour.
However, this is subject to prior reservation and is limited to a maximum of one hour.
If no prior reservation is made, a fee of 10,000 yen will be charged.
In such cases, guests must vacate the room within one hour of the check-out time.
3. Even within the time period during which guests may use the guest room pursuant to Paragraph 2, the facility may enter the guest room and take necessary measures for safety, hygiene management, or other operational management purposes as deemed necessary.
Article 9 Compliance with Terms of Use
Guests must comply with the terms of use established by the facility and the rules posted within the facility.
Article 10 (Payment of Fees)
1. The breakdown of accommodation fees and other charges payable by guests is set forth in Appendix 1.
2. Payment of the accommodation fees and other charges specified in the preceding paragraph may be made by credit card (online payment) at the time of booking or by bank transfer to the designated account of the facility.
3. Even if a guest chooses not to stay after the facility has provided the room and made it available for use, the accommodation fee will be charged.
4. Any additional charges incurred during the stay will be processed via credit card payment.
Article 11 (Liability of the Facility)
1. The facility shall compensate guests for damages caused by the performance or non-performance of the accommodation contract or related contracts, up to a maximum of 100,000 yen. However, this does not apply if the damages were not caused by the facility's negligence or fault.
2. The facility shall not be liable for any damage, soiling, or loss of items brought by guests to the facility, unless such damage, soiling, or loss is caused by the facility's intentional act or gross negligence.
Article 12 (Storage of Guests' Luggage or Personal Belongings)
1. The facility does not have staff on-site at all times. If a guest's luggage arrives at the facility prior to their stay, the facility will store it only if the guest has made a prior declaration at the time of reservation and the facility has agreed to it.
2. If a guest's luggage or personal belongings are left behind at the facility after check-out, the facility will generally store them for seven days including the day of discovery. If no claim for return is made by the guest during this period, the items will be reported to the nearest police station. However, valuables will be reported to the nearest police station immediately. Food items and other waste-like items will be disposed of at the facility's discretion on the same day.
3. The facility may inspect the contents of any left-behind luggage or personal belongings as necessary to determine the appropriate handling based on the nature of the contents, and may return them to the owner or dispose of them in accordance with the preceding paragraph. Guests may not object to such handling.
Article 13 (Responsibility for Parking)
1. When guests use the facility's parking lot, the facility provides the space but does not assume responsibility for managing the vehicles. However, if damage is caused due to the facility's intentional act or negligence in managing the parking lot, the facility shall be liable for compensation.
Article 14 (Responsibility of Guests)
1. If the facility suffers damage due to the intentional or grossly negligent acts of a guest, the guest shall compensate the facility for such damage.
Article 15 (Room Cleaning)
1. This facility is a fully booked villa, so we do not provide room cleaning or sheet changes during your stay.
However, if you notify us in advance (one day prior), we will accommodate your request at an additional cost.
Additionally, for stays of three nights or more, we will provide free room cleaning and sheet changes on the third night.
・Total amount payable by guests
Accommodation fees (rental fees for the entire building and fees included in the contract in advance)
Additional fees (BBQ and other pre-booked usage fees)
Taxes (consumption tax, etc.)
Note: In the event of a revision to tax laws, the revised provisions shall apply.
・Cancellation policy
The day before to the day of your reservation: 100% of the accommodation fee (including tax)
7 days or more prior to your reservation: 80% of the accommodation fee (including tax)
14 days or more prior to the reservation date: 50% of the total accommodation fee including tax
30 days or more prior to the reservation date: 30% of the total accommodation fee including tax
If the contracted stay period is shortened, cancellation fees will be charged according to the above ratios starting from the first day of the canceled period.
・Terms of Use
This facility has established the following rules in conjunction with the accommodation agreement to ensure safe and comfortable use by guests and to maintain the public nature of the entire-house rental villa. In the event of a violation of these rules, the accommodation contract may be terminated in accordance with Article 6 of the accommodation agreement.
Regarding usage
1. Please store valuables at your own risk. The facility shall not be liable for loss or theft in accordance with Article 11, Paragraph 2.
2. Accommodation for more than the maximum number of guests is not permitted. (Infants are not included in the number of guests.) We strictly refuse accommodation for more than the number of guests reserved.
3. Facility staff are not present from check-in to check-out.
4. We do not provide meals or beverages within the facility, but guests may bring their own ingredients, seasonings, and beverages for cooking and consumption. In such cases, please leave any utensils or appliances used in their original locations.
Regulations
1. Smoking is strictly prohibited throughout the facility. If smoke odors or stains are detected, guests may be required to cover the costs of house cleaning, bedding replacement, and other expenses.
2. If guests intentionally or accidentally damage or soil the villa facilities, appliances, furniture, or other items, they will be required to cover the full cost of repairs.
3. The facilities and equipment of this facility are loaned to guests for use during their stay and may not be taken home. Please do not take items out of the facility without permission, except for outdoor pool towels.
4. The following items are prohibited from being brought into the facility.
a. Explosives, gasoline, kerosene, chemicals, toxic gases, volatile oils, and other dangerous substances
b. Decaying substances, foreign objects, and other items that emit moisture, foul odors, strange odors, or other unpleasant smells
c. Pets
d. Excessively large quantities of items
e. Other items prohibited by law
Regarding Use
1. Minors may not use the facility alone.
2. Please refrain from behavior that disturbs public order or safety, loud conversations, or actions that cause inconvenience to neighbors.
3. Please refrain from using the facility for purposes other than lodging, such as business activities (exhibitions, etc.), without the permission of the facility manager.
4. Please refrain from speech or actions that cause significant inconvenience to the general public at adjacent facilities.
5. Anti-social use is prohibited.
6. If loud noises or other disruptive behavior occurs at the facility, it may be reported to the police by nearby residents. In such cases, the facility user will be held legally responsible for all consequences.
7. We assume no responsibility for any accidents caused by natural disasters, the negligence of villa users, or failure to comply with these regulations.
8. The facility manager and owner shall not be held liable for any damage, theft, or accidents involving vehicles or personal belongings brought by facility users.
9. Management staff will patrol the premises for management purposes.
10. Please refrain from making significant changes or decorations to the interior or exterior of the facility.
11. Please refrain from bringing in and using equipment such as large tents or charcoal BBQ sets on the premises that are not owned by the facility.
12. When using the outdoor pool, please do so at your own risk.
Security precautions
1. Please ensure that the facility is locked when leaving during your stay.
2. Please ensure that the facility is locked at all times, especially during sleep.
The terms and conditions may be changed without prior notice.
